First of all, a big THANK YOU to everyone who came to the protest rally on Thursday 16th - the turn-out was fantastic. We scored a good photo and article on page 2 of the SHN the following day and anticipate more coverage over the next few days.

P1090744The Commissioner spent all of Thursday hearing evidence on site in Governors St. We found this quite amazing as the evidence was supposedly restricted to new matters not previously heard at last year's court case.

He very carefully listened to evidence given by concerned residents, looked at the planned development on the site itself and inspected the property neighbouring the bore site which will probably be the most impacted by the development. In the afternoon he re-inspected Governors St, questioning the proposed roadworks and the affect on trees in the roadway.

On the following day the case continued at Picton courthouse. Twenty plus Bundanoon residents braved the privations of the court to listen to the legal arguments over the matter. John Brock drove the community bus for the day.

The morning session involved the expert evidence of Dr Martens, the engineering consultant used by Norlex to design a more environmentally acceptable roadway for Governor's St. In the afternoon, the arborists for Norlex and Council testified and were examined on the likelihood (or otherwise) of trees being damaged by the proposed roadworks.

Finally, the two barristers summed up their cases. Council's barrister included most of the items of objection that came from the community, and, we thought, did a great job in putting our case to the Commissioner.

We now have to wait for the Commissioner's decision. He will not even start looking at the evidence for 2 weeks (previous engagements), so we do not expect an early decision. Watch the community web site for further details.

    I am following your dabate and preparing an ethics paper on the great Southern Highland Bottle debate. My Interest in Bundanoon stems back to the 1950's as my father was the local Anglican minister for Sutton Forrest, Bundanoon, Moss Vale and Exeter.
